Guardian Advocacy
A court may appoint a guardian advocate for a person with developmental disabilities if the person lacks the capacity to do some, but not all, of the tasks necessary to care for his or her person, property, or estate. This type of guardianship can be used to name a guardian (such as a parent) for young adults with developmental conditions present before age 18 (such as autism or Down syndrome) who need support from their family and are not able to fully assume all responsibilities of adulthood on their own.
Incapacity Guardianship
A court may appoint a guardian for a person who has been adjudicated by the court as incapacitated. This guardian may be delegated rights that allow the guardian to manage the person’s property and/or rights that allow the guardian to care for the incapacitated person and his or her health.
